(१) यस संविधानमा अन्यथा व्यवस्था गरिएकोमा बाहेक उच्च अदालतको मुख्य न्यायाधीश तथा न्यायाधीशको पारिश्रमिक र सेवाको अन्य शर्त संघीय कानून बमोजिम हुनेछ ।
(२) उपधारा
(१) मा जुनसुकै कुरा लेखिएको भए तापनि न्याय परिषदबाट कारबाही भई पदमुक्त भएको वा नैतिक पतन देखिने फौजदारी कसूरमा अदालतबाट सजाय पाई पदमुक्त भएको उच्च अदालतको मुख्य न्यायाधीश तथा न्यायाधीशले उपदान वा निवृित्तभरण पाउने छैन । तर शारीरिक वा मानसिक अस्वस्थताको कारण सेवामा रही कार्य सम्पादन गर्न असमर्थ रहेको भनी न्याय परिषदले पदमुक्त गरेको अवस्थामा यो व्यवस्था लागू हुने छैन ।
(३) उच्च अदालतको मुख्य न्यायाधीश वा न्यायाधीशलाई मर्का पर्ने गरी निजको पारिश्रमिक र सेवाका अन्य शर्त परिवर्तन गरिने छैन । तर चरम आर्थिक विश्रृंखलताका कारण संकटकाल घोषणा भएको अवस्थामा यो व्यवस्था लागू हुने छैन ।
(1) Except as otherwise provided in this Constitution, the remuneration and other conditions of service of the Chief Judge and Judges of the High Court shall be provided for in the Federal law.
(2) Notwithstanding anything contained in clause
(1), the Chief Judge or a Judge of a High Court who has been removed from office upon action by the Judicial Council or upon punishment by a court for a criminal offence involving moral turpitude shall not be entitled to gratuity or pension. Provided that this provision shall not apply in cases where the Judicial Council has removed him or her from office on the ground of inability to perform the duties of his or her office because of physical or mental illness.
(3) The remuneration and other conditions of service of the Chief Judge or a Judge of the High Court shall not be altered to his or her disadvantage. Provided that this provision shall not apply in cases where a state of emergency is declared because of extreme economic disarrays.
