(१) नेपाल सरकारले कानून बमोजिम संघीय न्याय सेवाको राजपत्रांकित पदमा नियुक्ति, सरुवा, बढुवा गर्दा वा त्यस्तो पदमा बहाल रहेको कुनै कर्मचारीलाई विभागीय सजाय गर्दा न्याय सेवा आयोगको सिफारिस बमोजिम गर्नेछ । तर संघीय सरकारी सेवामा बहाल नरहेको व्यक्तिलाई संघीय न्याय सेवाको राजपत्रांकित पदमा नयाँ भर्नाद्वारा स्थायी नियुक्ति गर्दा वा संघीय न्याय सेवाको राजपत्र अनङ्कित पदबाट सोही सेवाको राजपत्रांकित पदमा बढुवा गर्दा नेपाल सरकारले लोक सेवा आयोगको सिफारिस बमोजिम गर्नु पर्नेछ । स्पष्टीकरण : यस धाराको प्रयोजनका लागि संघीय न्याय सेवाका े राजपत्रांकित पदमा नियुक्ति गर्दा लिइने खुला र आन्तरिक प्रतियोगितात्मक परीक्षा लोक सेवा आयोगले लिनेछ ।
(२) न्याय सेवा आयोगमा देहाय बमोजिमका अध्यक्ष र सदस्यहरू हुनेछन् :–
(क) प्रधान न्यायाधीश –अध्यक्ष
(ख) संघीय कानून तथा न्याय मन्त्री –सदस्य
(ग) सर्वोच्च अदालतको वरिष्ठतम न्यायाधीश –सदस्य
(घ) लोक सेवा आयोगको अध्यक्ष –सदस्य
(ङ) महान्यायाधिवक्ता –सदस्य
(३) न्याय सेवा आयोगको अन्य काम, कर्तव्य, अधिकार र कार्यविधि संघीय कानून बमोजिम हुनेछ ।
(1) In appointing, transferring or promoting gazetted officers of the Federal Judicial Service or taking departmental action concerning such officers in accordance with law, the Government of Nepal shall act on recommendation of the Judicial Service Commission. Provided that in making new permanent appointments to gazetted posts of the Federal Judicial Service from persons who are not already in the Federal 101 Government Service or making promotions from non-gazetted posts of the Federal Judicial Service to gazetted ones of that Service, the Government of Nepal shall act on the recommendation of the Public Service Commission. Explanation: For the purposes of this Article, the Public Service Commission shall hold open and internal competitive examinations to be held for appointments to Gazetted posts of the Federal Judicial Service.
(2) The Judicial Service Commission shall consist of the following as its chairperson and members:
(a) The Chief Justice - Chairperson
(b) The Federal Minister for Law and - Member Justice
(c) The seniormost Judge of the - Member Supreme Court
(d) The Chairperson of the Public - Member Service Commission
(e) The Attorney General - Member
(3) Other functions, duties, powers and procedures of the Judicial Service Commission shall be as provided for in the Federal law.
