मुख्यमन्त्री तथा मन्त्रीको पद रिक्त हुने अव

था :

(१) देहायको कुनै अवस्थामा मुख्यमन्त्रीको पद रिक्त हुनेछ :–

(क) निजले प्रदेश प्रमुख समक्ष लिखित राजीनामा दिएमा,

(ख) धारा १८८ बमोजिम विश्वासको प्रस्ताव पारित हुन नसकेमा वा निजको विरुद्ध अविश्वासको प्रस्ताव पारित भएमा,

(ग) निज प्रदेश सभाको सदस्य नरहेमा,

(घ) निजको मृत्यु भएमा ।

(२) देहायको कुनै अवस्थामा मन्त्रीको पद रिक्त हुनेछ :–

(क) निजले मुख्यमन्त्री समक्ष लिखित राजीनामा दिएमा,

(ख) मुख्यमन्त्रीले निजलाई पदमुक्त गरेमा,

(ग) उपधारा

(१) को खण्ड

(क),

(ख) वा

(ग) बमोजिम मुख्यमन्त्रीको पद रिक्त भएमा,

(घ) निजको मृत्यु भएमा ।

(३) उपधारा

(१) बमोजिम मुख्यमन्त्रीको पद रिक्त भए तापनि अर्को प्रदेश मन्त्रिपरिषद गठन नभएसम्म सोही मन्त्रिपरिषदले कार्य सञ्चालन गर्नेछ । तर मुख्यमन्त्रीको मृत्यु भएमा अर्को मुख्यमन्त्री नियुक्ति नभएसम्मका लागि वरिष्ठतम मन्त्रीले मुख्यमन्त्रीको रूपमा कार्य सञ्चालन गर्नेछ ।

(1) The office of the Chief Minister shall be vacant in any of the following circumstances:

(a) if he or she tenders resignation in writing to the Chief of State,

(b) if a vote of no-confidence is passed against him or her under Article 188 or a vote of confidence is not passed,

(c) if he or she ceases to be a member of the State Assembly,

(d) if he or she dies.

(2) The office of a Minister shall be vacant in any of the following circumstances:

(a) if he or she tenders resignation in writing to the Chief Minister,

(b) if the Chief Minister removes him or her from office,

(c) if the office of the Chief Minister falls vacant under sub-clause

(a),

(b) or

(c) of clause

(1),

(d) if he or she dies.

(3) Even though the office of the Chief Minister falls vacant under clause

(1), the same Council of Ministers shall continue to act until another State Council of Ministers is constituted. Provided that if the Chief Minister dies, the senior-most Minister shall act as the Chief Minister until a new Chief Minister is appointed.
